Certified payroll in Ohio

Ohio runs its own prevailing-wage law for state and local public improvements, alongside the federal Davis-Bacon rules that apply when federal money is in the project. The items below are the load-bearing facts, each linked to the statute it comes from.

Statute

Ohio's prevailing wage law is Ohio Revised Code Chapter 4115; ORC 4115.03 defines the covered 'public improvement' and the coverage thresholds.

Coverage threshold

Under ORC 4115.03, the general threshold reached $250,000 for new construction and $75,000 for reconstruction, enlargement, alteration, repair, remodeling, renovation, or painting (phased in after September 29, 2011). Separate, biennially adjusted thresholds apply to road- and bridge-related work.

Filing cadence

Under ORC 4115.071, the contractor delivers a certified copy of its payroll to the public authority's prevailing wage coordinator within two weeks after the initial pay date, and supplemental certified payrolls monthly — or weekly when the contract is expected to run four months or less. Federally funded Ohio projects follow the federal weekly rule instead.

Certified payroll contents

Under 29 CFR 5.5(a)(3)(ii), contractors must submit certified payrolls weekly for each week in which covered work is performed. The payroll needs only an individually identifying number for each worker — for example, the last four digits of the worker's Social Security number — and each submission carries a signed Statement of Compliance. Optional Form WH-347 satisfies the requirement.
