Certified payroll in New York

New York publishes its own prevailing-wage schedules and now requires certified payroll to be filed with the state electronically. The items below link to the state Department of Labor page they come from.

Statute

New York's prevailing wage requirements for public work are established by Article 8 of the New York State Labor Law, enforced by the Bureau of Public Work and Prevailing Wage Enforcement.

Where determinations are published

The Bureau publishes the annual prevailing wage schedule on the first of July each year; current and archived schedules are on the NYS DOL website.

Electronic certified payroll

As of December 31, 2025, contractors and subcontractors on covered New York public work must submit certified payroll documentation electronically through the state's Certified Payroll portal (via MPWR); contractor registration with the Department of Labor has been required since December 30, 2024.

Certified payroll contents

Under 29 CFR 5.5(a)(3)(ii), contractors must submit certified payrolls weekly for each week in which covered work is performed. The payroll needs only an individually identifying number for each worker — for example, the last four digits of the worker's Social Security number — and each submission carries a signed Statement of Compliance. Optional Form WH-347 satisfies the requirement.

Davis-Bacon wage determinations are published by the U.S. Department of Labor on SAM.gov, searchable by WD number or by location and construction category.
